Royalty Free Limited Use

A royalty free, limited time use of only the HealthKeeper software generated NutriCodes and the HealthKeeper software generated output is allowed for overheads, nutritional education materials or brochures, cookbooks, health program support, menus, labels, food art etc., provided that:

(1) the user of the NutriCodes and/or HealthKeeper software output owns a registered copy of HealthKeeper software in their name.

(2) the below copyright notice and our web address appears in any and all copies and any graphic presentation incorporating the NutriCode or any HealthKeeper software output.

"Used with permission. Copyright © 1997-2001 HealthKeeper Inc., NutriCode patent pending, all rights reserved. <www.health-runr.com>."

(3) No than 100 copies of that information in total over any period of time may be created without first obtaining written permission from HealthKeeper Inc. (If more than 100 copies are made in some cases there may be a small license fee for commercial businesses.)

(4) no quantitative modifications of any HealthKeeper computer-generated

NutriCodes are made.

(5) no NutriCodes and/or any other HealthKeeper software output was used or incorporated into any other software product without first obtaining written permission HealthKeeper Inc.

(6) the HealthKeeper software output specified above in 1-5 does not include the actual screen design or graphic layout of the HealthKeeper nor does it include any logo, graphic, sound or image from the HealthKeeper software. Logos, graphics, sound or images or other layout and design elements of the HealthKeeper software are protected by trade dress and other laws and may not be copied or imitated in whole or in part without first obtaining written permission from HealthKeeper Inc.

(7) The first royalty free limited use period, qualified by the terms in 1-6 above, shall be from October 1, 2000 until October 1, 2004.

Use for any other purpose or outside of the terms specified above without a valid HealthKeeper commercial license is expressly prohibited by law, and may result in severe civil and criminal penalties. Violators will be prosecuted to the maximum extent possible.
